Thwaites slaps injunction on Barford
Dumper manufacturer Thwaites has obtained a temporary injunction
against Barford Site Dumpers, part of Wordsworth Holdings.
The injunction stops the sale of some models in Barford's new
dumper range. It claims infringement of copyright and design right
by the new Barford SX5000, SX6000, SX7000 and SXR5000 (rotary skip)
machine.
Wordsworth Holdings strongly refutes all of the allegations and
states that it will defend its position tenaciously. Indeed it
'looks forward to the opportunity at trial of having its position
fully vindicated.'
Thwaites is primarily concerned about protecting its engineering
ideas although it is understood that these have never been
patented.
Barford says it has delivered 37 dumpers in March which is a brisk
start for a new product in a mature sector. Thwaites has given an
undertaking to the court to recompense Barford for possible losses
if it is prevented from supplying some models in its new range. If
Barford wins then Thwaites may be in for a substantial financial
headache.
