Tarmac is suing developer Atlantic Property Developments for more
than œ400,000 over a row on a retail park contract in
Wales.
The claim arose after Tarmac completed the œ2.5 million
Valegate retail park for Atlantic at Culverhouse Cross near
Cardiff.
A Tarmac spokesman said: 'Atlantic is witholding this money even
though the work is complete and has been appropriately certified by
the architect.'
Tarmac was the main contractor on the scheme.
Atlantic said that it had no quarrel with the construction element
of the contract.
A spokesman said: 'The project was satisfactorily completed on 9
December last year. However Tarmac were to release contractor
warranties upon practical completion and this it has not done.
'This is why we are witholding the money.'
The Atlantic spokesman added that all other payments had been made
in full and on time. As CJ went to press Atlantic directors were
planning to meet lawyers to discuss Tarmac's claim.
Tarmac responded to Atlantic's statement by saying that the
warranties were not given because of wider contractual
complications which the company could not discuss further.
