Brickwork contractor Fastrack has won its second adjudication case
against Morrison Construction, this time awarded over
£120,000.
Fastback was subcontracted to the joint-venture developer Morrison/
Impreglio on the £17.5 million Leisure World and Arena sites
in Coventry and was scheduled to finish by the December 1998, but
delays ensued.
Fastback walked off site on 12 March 1999, and began adjudication
proceedings, initially for £36,000. Andrew Jack, Fastrack
managing director, told CJ: "We wanted to get a feel for
adjudication because this is a new procedure and we were working
blind. There was an indisputable amount outstanding which was
£36,000, which we wanted straight away to pay legal costs for
the larger legal dispute of £120,000." The firm won the first
adjudication on 17 May.
Fastrack then began proceedings on the second adjudication and was
awarded full costs plus damages, interest, and costs last week.
Jack added: "I will never work for Morrison again."
As CJ went to press, Morrison had not settled the account, and was
being charged £24 for every day it was outstanding. A
spokesman for Morrison said: "We are unable to comment because this
is still the subject of legal activity."
