Highway Works Strategic Partnering Contract
Expressions of interest are being sought from suitably experienced
contractors with the appropriate technical capabilities and financial
resources who wish to be considered for inclusion on the Council's Select
List of Tenderers/Bidders for the formation of the above proposed Strategic
Partnering Contract.
A contractor(s) is being sought to assist in the management and delivery of
the council's programme of highway maintenance and improvements on a
strategic partnering basis. The successful contractor(s) will be expected
to make a significant contribution to the council's approach to the

continuous improvement of this programme by working in collaboration with
the council's design teams, participating in the management of the
programme and the execution of works. The contract will be let using the
New Engineering Contract, in particular using the target contract with
activity schedule option. The contract is to provide a range of highway
functions including the following:
(a) Scheduled and Unscheduled structural maintenance activities;
(b) Street lighting maintenance;
(c) Footway, cycleway and highway verge maintenance;
(d) Traffic Signal maintenance (lamps);
(e) Signing and lining maintenance;
(f) Car park maintenance;
(g) Bus infrastructure maintenance;
(h) Public Rights of Way maintenance;
(i) Highway drainage maintenance;
(j) Highway flooding matters;
(k) Highway gully cleaning;
(l) Bridge maintenance;
(m) Coastal defence maintenance;
(n) Minor highway improvements;
(o) Winter maintenance of highways and
(p) Emergency Response.
The proposed contract shall commence on 01 April 2004 and will be awarded
for an initial period of three years but may be extended for at least a
further two years subject to the continued achievement of the partnering
objectives.
It is anticipated that there will be a transfer of staff under the EC
Directive on Acquired Rights (Council Directive 77/187/EEC) implemented by
the UK Transfer of Undertakings (Protection of Employment) Regulations 1991.
It is anticipated that the annual value of the works will be in the region
of £5,000,000. In addition, it should be noted that the Council is seeking
PFI credits to undertake street lighting maintenance activities. If
successful, it is anticipated that the street lighting maintenance
activities will not form part of this contract after December 2005.
Applications from contractors who wish to be considered will be required to
submit the following information to determine their technical, economic and
financial capabilities:
If a company, proof of enrolment on a professional trade register, or
register of companies in which the contractor is established;
Financial status and Baker's Statement;
Balance sheets/accounts for the past 3 financial years, including a
statement of turnover on highway maintenance/highway construction works;
Previous experience in highway maintenance/highway construction under a
Partnering Agreement;
A list of highway maintenance/highway construction over £3.0m carried out
over the past 5 years, the value and location of each contract, the
Authority for whom executed and accompanied by certificates of satisfactory
execution for the most important works;
Evidence of the contractor's educational and professional qualifications
and those of the firm's managerial staff and, in particular, those of the
person or persons responsible for carrying out the works;
Statement of the technicians or technical services which the contractor can
call upon for carrying out the works whether or not they belong to the firm;
Statement of the firm's annual average manpower and the number of
managerial staff for the last 3 years;
Statement of the tools, plant and technical equipment available to the
contractor for carrying out the works.
In accordance with the Construction (Design and Management) Regulations
1994 the successful tenderer will be appointed to fulfil the duties of the
Principal Contractor and the duties thereof.
Contractors responding to this notice are, therefore, required to provide
with their written expressions of interest a health and safety statement
containing the following information:
A statement of the company's policy on health and safety, including the
training and welfare of the staff at construction sites;
A breakdown of the company's organisation showing the position of staff
within the company management structure with specific responsibilities for
health and safety;
A description of the company resources devoted to health and safety issues,
in terms of staff and their relevant qualifications and experience.
A written undertaking that they are willing to accept the appointment as
Principal Contractor under the Construction (Design and Management)
Regulations 1994 if awarded the contract.
To register an expression of interest in being considered for this
contract, contractors should submit the above details to the Director of
Development, Belmont House, Rectory Lane, GUISBOROUGH TS14 7FD no later
than 12.00 noon on Monday 1 December 2003. It is anticipated that tender
documentation will be issued to successful tenderers/bidders on Monday 15
December 2003 and shall be returned on Monday 26 January 2004.
