Bath Spa heads for court
Bath & North East Somerset Council (BANES) is in a "strong
position" to take legal action against Mowlem over the £26m
Bath Spa contract, according to one council source.
The insider told CJ that initial feedback from the scrutiny panel,
set up to review the escalating costs of the project caused by the
flaking of paint in the spa's four pools, could now give the go
ahead for BANES to pursue Mowlem for costs valued at up to
£4.3m.
Possible legal action could also lead to an inquiry into the
two-year delay to the project.
BANES would not comment officially on the claims, but said that
"positive negotiations" are taking place.
Mowlem has maintained its position that the paint problems were
down to the type of paint specified by the project's architect
Grimshaw & Partners. The latter has refused to comment.
CJ can also reveal that Dutch firm Bovitec Bouwchemie has been
awarded a contract by Mowlem to resurface the spa's pools with a
two-part Krautoxin epoxy paint.
