Construction firms McNicholas and Instalcom were fined a total
of £37,500 at the Old Bailey today (Monday) after a member of
the public was struck and killed by a lorry.
McNicholas, of Kingsbury Road, London was fined £25,000 and
Instalcom, of South Harrow, Middlesex, was ordered to pay
£12,500 for their involvement in a project to re-lay footpaths
on 7 September 2001.
Mrs Zafoora Begum was crossing Eastern Avenue (A12), Gants Hill,
when a reversing works lorry operated by Instalcom struck
her.
McNicholas and Instalcom both pleaded guilty under Section 3(1) of
the Health and Safety at Work Act etc 1974, for failing to ensure
the safety of people it did not employ.
McNicholas was also ordered to pay £12,770 in costs as it was
the main sub-contractor and a limited company. Instalcom had to pay
£10,000 costs.
