Brown Mac and Instalcom fined £37,500
McNicholas plc ('brown Mac') and Instalcom were fined a total of
£37,500 at the Old Bailey on Monday after a member of the
public was struck and killed by a lorry.
McNicholas was fined £25,000 and Instalcom, based in South
Harrow, Middlesex, was ordered to pay £12,500. They were
re-laying footpaths on 7 September 2001 when the incident
happened.
Zafoora Begum was crossing Eastern Avenue when a reversing works
lorry operated by Instalcom struck her.
McNicholas and Instalcom both pleaded guilty under Section 3(1) of
the Health and Safety at Work Act etc 1974 for failing to ensure
the safety of people it did not employ.
McNicholas was also ordered to pay £12,770 in costs. Instalcom
had to pay £10,000 costs.
