High Court gives Emcor verdict
The High Court has ordered a Costain Skanska joint venture (CSJV)
to pay Emcor Drake & Scull (EDS) £200,000-plus for delays
to the Great Western Royal Hotel in Paddington.
The High Court upheld an adjudicator's decision that CSJV should
extend the time on the contract, and awarded the M&E specialist
£201,069.
EDS applied for three extensions. The company claimed CSJV was in
breach of contract and made claims to extend the work from July
2001 to February 2002. It also claimed work was held up by problems
with access to the bedrooms and delays to drawings.
An adjudicator rejected the first claim, after he decided EDS had
not shown that critical delays to the bedrooms entitled it to an
extension. EDS went to adjudication again and won. CSJV then
appealed.
A Costain spokesman said CSJV is considering its next course of
action.
