Masons' delegates vote in favour of adjudication
Adjudication is a workable and welcome solution in construction disputes, but it can be improved, according to delegates at Masons' Annual Law Conference.
Voters narrowly defeated the motion: "The three principles of adjudication - any dispute, any time and 28 days - have proved unworkable and need reform." However, when the three principles were examined individually, the audience voted to put a deadline on bringing adjudications.
The second proposition: "Court regulation brings much-needed and welcome justice to an unjust procedure," was narrowly approved, suggesting contractors value the safety net of court intervention for erroneous adjudications.
The final motion: "Adjudi-
cation has created a justice gap that other forms of dispute resolution are not currently filling," was overwhelmingly defeated.
Masons is merging with Pinsents on 6 December to create a £150m turnover, 240-partner, top-15 legal business. The firm will be known as Pinsent Masons.
