Roads contractors working in Scotland that perform poorly could face penalties and possible contract termination under proposals being drawn up by the Scottish Executive for a new Scottish road works commissioner.
The new role, which is expected to be filled early next year, is being drawn up as part of the Transport (Scotland) Bill. The commissioner’s responsibilities will extend to all roads authorities and utility companies in Scotland.
The commissioner will be responsible for drawing up and handling a Scottish road works register. This will be monitored and regulated to ensure that highways works, such as utility provision and trunk road maintenance, are carried out to the correct standard and are on time and budget.
If a contractor falls behind, it can expect steep penalties or termination of the contract depending on the severity of the offence.
The full details of the commissioner’s powers and responsibilities have yet to be agreed and are not expected to be confirmed until the bill receives Royal Assent next month.
