Hudson beats HMRC in tax case

Yorkshire-based Hudson Contract Services has successfully defended another case against HM Revenue & Customs (HMRC) in the High Court.

The legal battle, led by top tax barrister, Jolyon Maugham, focused on the right of Hudson to act as a tax facilitator between self-employed workers and contractors. Hudson charges contractors £15 per worker, per week for the service.

The case hinged on Hudson being issued with a CIS registration card under the provisions of the Income and Corporation Taxes Act 1988.

However, judge Mr Justice Pumfrey ruled that Hudson was lawfully entitled to operate in the way it had been.

He added that under the scheme, Hudson was paid for taking responsibilities that would otherwise fall on the contractors in respect of the deductions from subcontractors.
