The Health & Safety Executive (HSE) is to prosecute Plymouth City Council following the death of an employee who used a forklift as a work platform.
The incident took place in February 2007. The HSE is prosecuting Plymouth for five breaches of health and safety regulations, including failing to ensure the safety of employees and failing to provide proper training.
Rory Littley, 22, was standing on the raised forks of the forklift while he unloaded a truck. The forklift lurched forward and he was crushed against the back of the truck.
The coroner's inquest recorded a verdict of death by misadventure.
Plymouth has not submitted a plea for any of the five charges and will stand trial on 2 October.
