The discussion seems to be moving away from the original issue! The general position is that one party cannot vary a contract without the agreement of the other party. It would be very unusual for a contract to allow a unilaterally change - and the fact letters have been sent out by main contractors...

There was a big jump in foreign workers killed on construction sites last year - up 50% from 8 to 12. Of course, that may be partly because there are more foreign workers over here.

Impact of foreign workers on construction health and safety?

On another thread, Basher makes the point about how difficult it can be explaning health and safety issues to migrant workers who do not speak English. Do people think that the massive influx of foreign workers of the last few years has made construction sites less safe?
